PRERANA MOBILE TERMS AND CONDITIONS

WISDOMKRAFT EDUTECH SERVICES PRIVATE LIMITED

These Terms and Conditions govern access to and use of Prerana Mobile, an educational mobile application provided by WISDOMKRAFT EDUTECH SERVICES PRIVATE LIMITED. In these Terms, "Company", "we", "us", and "our" refer to WISDOMKRAFT EDUTECH SERVICES PRIVATE LIMITED, and "User", "you", and "your" refer to any person accessing or using the Service or the adult/organization acting on that person's behalf.

Please read these Terms together with the related Prerana Mobile Privacy Policy and AI Usage in Education Policy.

1. Introduction and Agreement

1.1 These Terms

These Terms & Conditions constitute an agreement between you and WISDOMKRAFT EDUTECH SERVICES PRIVATE LIMITED regarding your access to and use of Prerana Mobile and associated educational services.

1.2 Acceptance

By downloading, accessing, setting up an account for, or using Prerana Mobile, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Service. If you are a parent, legal guardian, teacher, school administrator, or authorized representative, you agree both for yourself and, to the extent permitted by law, on behalf of the learner or organization for whom you act.

1.3 Related Policies

Our Privacy Policy and AI Usage in Education Policy describe additional rules and information practices. Each policy forms part of your agreement with us and should be read together with these Terms.

2. Definitions and Interpretation

2.1 Definitions

Service means Prerana Mobile and related pages, educational features, materials, and support made available by the Company.

Content means lessons, explanations, questions, practice exercises, quizzes, learning summaries, progress records, text, images, software, and other materials provided through the Service.

User Content means notes, documents, questions, prompts, text, images, files, or other materials submitted or uploaded by a User through the Service.

AI Output means any explanation, answer, summary, suggestion, or resource produced through an AI-enabled feature of the Service.

2.2 Interpretation

Headings are for convenience only and do not affect interpretation. References to writing include email. If any provision is limited by applicable law, it applies to the maximum lawful extent while the remainder remains in full effect.

3. Eligibility and Education Arrangements

3.1 Minimum Age

Prerana Mobile is intended for learners aged 6 and above. A learner below the age of majority must use the Service with appropriate adult supervision.

3.2 Children Under 13

Children under 13 years of age may use the Service only where a parent or legal guardian has provided required consent and completed verification. The adult providing consent is responsible for reviewing these Terms and supervising the child's use of the Service.

3.3 Schools, Teachers and Parents

A school, teacher, parent, or legal guardian may establish or manage accounts for learners. The person or organization managing access must be authorized to do so, provide accurate details, and ensure that learners comply with these Terms and educational guidelines.

3.4 Authority

You must not create an account or arrange access for another person unless you have authority to do so. The Company may request reasonable verification of authority, age, or consent.

4. Accounts and Account Protection

4.1 Account Accuracy

Where a feature requires setting up an account, you must provide accurate information and keep it updated. You must not create an account using false information or impersonate another person.

4.2 Account Protection

You are responsible for keeping information used to access the account confidential, protecting access to the phone, tablet, or other equipment you use, and promptly notifying the Company of any suspected unauthorized access.

4.3 Account Activity

You are responsible for activity carried out through your account, except where caused directly by the Company's failure to exercise reasonable care. Parents, legal guardians, teachers, and school administrators should provide appropriate oversight for young learners.

5. Educational Services and Resources

5.1 Nature of the Service

Prerana Mobile provides educational resources and learning tools, which may include study materials, topic explanations, AI tutoring assistance, practice exercises, learning summaries, progress tracking, and educational library features. Available features may vary depending on device, region, or service version.

5.2 Educational Purpose

The Service is designed as an educational learning aid. It does not replace qualified teachers, official school curricula, parental supervision, or professional guidance. Test scores, exercise results, and progress summaries do not guarantee specific academic marks or outcomes.

5.3 User Responsibility

Users are responsible for checking study materials, following school instructions, and exercising independent judgment when relying on learning resources. Parents and educators should evaluate suitability for learners in their care.

6. AI-Enabled Features and Gemini

6.1 AI Functionality

Prerana Mobile offers interactive AI learning features, such as virtual tutoring assistance, subject explanations, and study resource generation. These features use Google Gemini as the AI service provider.

6.2 Accuracy Limitations

AI Output is generated automatically and may occasionally be inaccurate, incomplete, outdated, or unsuitable. AI Output must be independently reviewed and verified against official textbooks or teacher guidance.

6.3 No Professional or Emergency Advice

AI features are intended exclusively for general educational assistance. They do not provide medical, legal, financial, safeguarding, or emergency advice. Do not rely on AI features for urgent or high-risk decisions.

6.4 Responsible Use of AI Output

Users must not present AI Output as independently created work where disclosure is required by a school or educator. Users must adhere to academic integrity standards and school rules.

7. Academic Integrity and Learning Conduct

7.1 Honest Participation

Users must complete study activities honestly. You must not use the Service to cheat, submit another person's work as your own, or obtain unauthorized assistance during assessments.

7.2 Educator Discretion

Schools, teachers, and parents may establish additional academic conduct rules for assignments. Nothing in these Terms restricts an educational institution's authority to assess student conduct under its own rules.

8. User Responsibilities and Acceptable Use

8.1 Lawful and Respectful Use

You must use the Service lawfully, respectfully, and solely for legitimate educational purposes. You must respect the privacy, safety, and intellectual property rights of learners, educators, the Company, and third parties.

8.2 Prohibited Conduct

You must not:

Misuse, disrupt, or interfere with the proper operation of the Service;

Attempt to gain unauthorized access to accounts, service information, or non-public areas;

Use the service to distribute harmful or unlawful material;

Copy or download large amounts of Prerana content without permission;

Copy, reproduce, or obtain protected parts of Prerana Mobile without permission, except where applicable law allows it;

Upload unlawful, abusive, deceptive, defamatory, or infringing content; or

Use the Service for fraudulent or harmful activities.

8.3 Reporting Violations

Concerns regarding misuse, inappropriate content, child safety, or copyright infringement should be reported to murshidsmartguru@gmail.com.

9. User Content

9.1 Your Responsibility

Where supported, Users may upload study notes, practice questions, documents, or images. You are responsible for ensuring that you hold all necessary rights and permissions for any material you submit. Do not upload confidential information or personal details of others without authorization.

9.2 Permission to Operate

By submitting User Content, you grant the Company a limited, non-exclusive, royalty-free permission to host, process, display, format, and transmit your User Content solely to operate, support, and provide educational features to you. This permission does not transfer ownership of your User Content to the Company.

9.3 Content Removal

The Company reserves the right to remove or decline to process User Content that violates these Terms, infringes rights, or compromises service security or safety.

12. Availability, Maintenance and Changes

12.1 Service Availability

The Company strives to keep the Service reliable and available but does not guarantee uninterrupted or error-free operation. Access may be temporarily affected by maintenance, updates, or events beyond our reasonable control.

12.2 Feature Modifications

The Company may update, modify, or discontinue specific features or resources. Where a change materially impacts active usage, the Company will provide reasonable notice where practicable.

13. Fees and Access

13.1 Free Access

Prerana Mobile is currently provided free of charge. Users remain responsible for third-party internet and data charges.

13.2 Future Offerings

If paid features or optional subscriptions are introduced in the future, clear pricing and terms will be presented before any charges are incurred.

14. Privacy and Communications

14.1 Privacy Policy

Handling of user information is governed by the Prerana Mobile Privacy Policy. Please review the Privacy Policy to understand how information is collected, used, and protected.

14.2 Operational Communications

The Company may send essential service communications related to account management, safety updates, or educational features. Parents and educators should ensure contact details remain current.

15. Suspension and Termination

15.1 Action by the Company

The Company may suspend or terminate access to the Service or close an account if a User violates these Terms, poses a safety risk, engages in harmful conduct, or if the Service is discontinued.

15.2 Action by the User

You may stop using the Service at any time. A parent, legal guardian, teacher, or school administrator may withdraw or close a managed account under their control.

15.3 Survival

Provisions concerning intellectual property, disclaimers, limitation of liability, governing law, and dispute resolution survive termination of your access to the Service.

16. Account and Information Requests

16.1 Requests

16.2 Account Deletion

Account closure and personal data deletion are already available in Prerana Mobile app settings and via email request to murshidsmartguru@gmail.com. Requests are processed subject to identity verification and statutory retention rules.

17. Disclaimers

17.1 Provided "As Available"

To the maximum extent permitted by applicable law, Prerana Mobile and its Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, or suitability for a particular curriculum.

17.2 Educational and AI Limitations

The Company does not warrant that AI Output or study resources will produce specific test scores, fulfill specific school requirements, or be error-free. Users must exercise independent judgment.

18. Limitation of Liability

18.1 Scope

To the maximum extent permitted by applicable law, WISDOMKRAFT EDUTECH SERVICES PRIVATE LIMITED, its directors, employees, or partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, academic opportunity, or goodwill arising out of or related to your use of the Service.

18.2 Balanced Allocation of Risk

Nothing in these Terms excludes or limits liability for statutory consumer rights, child protection requirements, or obligations that cannot lawfully be excluded under applicable law.

19. Indemnity and Responsibility for Misuse

19.1 User Responsibility

You are responsible for your unlawful, fraudulent, or infringing use of the Service and for User Content you submit. If you arrange access for a learner, you are responsible for having authority to make that arrangement.

19.2 Cooperation

To the extent permitted by law, you agree to cooperate reasonably with the Company in addressing any third-party claim resulting directly from your intentional misuse or infringement. This section does not require a child to indemnify the Company.

20. Governing Law and Disputes

20.1 Applicable Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

20.2 Informal Resolution

Before initiating formal legal proceedings, the parties agree to attempt to resolve any dispute in good faith by contacting murshidsmartguru@gmail.com.

20.3 Jurisdiction

Subject to applicable consumer protection laws, disputes arising out of these Terms shall be subject to the jurisdiction of competent courts in India.

22. Changes to These Terms

The Company may update these Terms from time to time to reflect changes in legal obligations, features, or operational practices. The updated version will indicate its effective date. Continued use of the Service after changes become effective indicates acceptance of the updated Terms.
